Terms of Service
Effective June 23, 2026 · Marqlex, Colorado Springs, COThese terms govern your relationship with Marqlex. By engaging our services, you agree to them. If something isn't clear, email us before signing anything — we'd rather talk it through.
1. Services
Marqlex provides website design, development, and hosting services as described in your selected plan. The scope of each project is defined at the time of engagement. Work outside that scope may be quoted and billed separately.
2. Payment
- The one-time setup fee is due before work begins. No payment, no start.
- The monthly retainer covers hosting, maintenance, and ongoing support.
- Retainer billing is month-to-month on the same date each month.
- A 7-day grace period applies to late retainer payments before any action is taken.
3. Ownership
You own your website. All design, code, and content created for your project belongs to you once the setup fee is paid in full. Marqlex provides hosting as part of the monthly retainer — we do not retain ownership of your site or its contents.
4. Site availability
| Situation | What happens |
|---|---|
| Retainer current | Your site is live and fully maintained. |
| Payment lapsed (within 7-day grace) | Site stays live. We'll reach out. |
| Payment lapsed (beyond 7 days) | Marqlex may take the site offline until payment is received. |
| Payment received | Site restored promptly. |
5. Cancellation
You can cancel at any time — no notice period required. Here's how it works:
- Your site remains live through the end of your current billing period.
- No prorated refunds for the remaining days in a billing period.
- After the billing period ends, your site comes offline.
Account in good standing: Full site files delivered to you within 3 business days of the site coming offline.
Outstanding balance: Site files are held until the balance is cleared in full, then delivered within 3 business days.
6. Client responsibilities
- You are responsible for providing accurate content, images, and approvals.
- Project timelines depend on your responsiveness. Delays on your end do not pause billing.
- You are responsible for the accuracy and legality of all content on your site.
7. Revisions
Reasonable revisions are included during the build phase as defined in your plan. Revision requests after launch, or changes outside the original scope, will be assessed individually and may be quoted separately.
8. Limitation of liability
Marqlex is not liable for losses resulting from third-party service failures including but not limited to hosting infrastructure, domain registrars, DNS providers, or payment processors. Our total liability to you for any claim is limited to the fees paid to Marqlex in the 30 days preceding the claim.
9. Governing law
These terms are governed by the laws of the State of Colorado. Any disputes will be resolved in Colorado Springs, Colorado.
